Terms and Conditions (AGB) — deluxe-sonnenschirme.ch

1. Scope and Contracting Party

These General Terms and Conditions ("Terms") apply to all orders placed by customers ("Customer") through the online shop Deluxe Sonnenschirme (deluxe-sonnenschirme.ch) with Deluxe Moebel GmbH ("Deluxe Moebel GmbH" or "we"), operator of the online shop deluxe-sonnenschirme.ch. By completing an order, the Customer agrees to these Terms. These Terms are available at deluxe-sonnenschirme.ch/agb. For questions, our customer service can be reached at info@deluxe-moebel.ch.

2. Prices

All prices stated on deluxe-sonnenschirme.ch are in Swiss francs (CHF) and include the applicable value-added tax (VAT/MWST). Delivery within Switzerland and the Principality of Liechtenstein and collection from the showroom in Bischofszell are included in the price and free of charge for the Customer (Section 4).

3. Payment Terms

The full purchase price is payable when the order is placed. We accept the following payment methods:

  • Credit/debit card (Visa, Mastercard, American Express) — processed via Stripe
  • TWINT
  • Apple Pay and Google Pay — processed via Stripe
  • Invoice / advance payment with a Swiss QR-bill: the Customer pays the order using the QR-bill provided; delivery takes place after receipt of payment.

4. Delivery Terms

Deluxe Moebel GmbH delivers exclusively within Switzerland and the Principality of Liechtenstein. Delivery usually takes place within 3 weeks. The delivery period begins once the order has been received with all information required to process it (e.g. model, size, fabric colour); for payment by invoice / advance payment, it begins once payment has been received. If the Customer chooses collection, the goods will usually be ready at the showroom within the same period; the Customer will be notified as soon as they can be collected.

Delivery is free of charge and made to the kerbside within Switzerland and the Principality of Liechtenstein. Smaller items (e.g. protective covers, spare parts, accessories) are shipped by parcel service; larger products (e.g. parasols, bases) are shipped by freight forwarder (Spedition).

Alternatively, the goods can be collected free of charge from the Deluxe Moebel GmbH showroom in Bischofszell by prior appointment (shipping method "Pickup at the Bischofszell showroom").

Delivered goods remain the property of Deluxe Moebel GmbH until the purchase price has been paid in full (retention of title).

5. Acceptance of Delivery

The Customer is notified upon arrival of the goods and undertakes to accept the agreed delivery or collection within the agreed timeframe.

6. No Right of Return

There is no right of return or exchange. Returns of defective goods (Sections 7 and 8) and of incorrectly delivered goods remain reserved. Such returns must be announced to Deluxe Moebel GmbH in advance, in writing or by e-mail to info@deluxe-moebel.ch. In these cases, Deluxe Moebel GmbH bears the costs of the return shipment.

7. Inspection and Notice of Defects

The Customer must inspect the goods upon receipt and notify Deluxe Moebel GmbH of any complaints without delay. If the Customer fails to inspect the goods, to raise a complaint, or to provide evidence of the defect (e.g. photographs), the goods are deemed accepted. Hidden defects remain reserved.

8. Warranty

Goods purchased from Deluxe Moebel GmbH are covered by the manufacturer's warranty of Glatz AG as set out in Glatz's warranty terms and the operating manual of the respective product. For the scope and conditions of the warranty, please refer to the manufacturer's warranty information (Glatz); we accept warranty claims via our contact form and handle them with the manufacturer. Excluded from the warranty are damages caused by wear and tear, aging, or improper use. The right to choose the remedy for warranty claims (repair, replacement, price reduction, or rescission) rests exclusively with Deluxe Moebel GmbH.

9. Governing Law and Jurisdiction

These Terms and all contracts concluded via deluxe-sonnenschirme.ch are governed exclusively by substantive Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms or contracts concluded via deluxe-sonnenschirme.ch is Bischofszell, Canton of Thurgau, unless mandatory statutory provisions provide otherwise.

10. Interpretation / Language Versions

These Terms are available in German, English, French and Italian. In the event of any contradiction or ambiguity between the language versions, the German version shall always prevail.
